Mobile Terms

These Mobile Terms (“Mobile Terms”) apply to text and messaging communications with Elrond Health Inc., a Delaware corporation doing business as Rivendell in New York and Rivendell Insurance & Administration Services in California (“Rivendell,” “we,” “our,” or “us”).

1. Scope

These terms govern messaging communications between you and Rivendell through Apple iMessage, SMS/MMS text messaging, or any other mobile messaging platform we may use to provide customer support and service-related communications. Our support number is (646) 600-8840.

2. Consent

By providing your mobile phone number and initiating or opting in to receive messages from Rivendell, you consent to receive recurring informational and service-related messages from or on behalf of Rivendell at the phone number you provided. These messages may include:

  • Enrollment and scheduling reminders
  • Customer support responses
  • Plan information and service updates
  • Other communications related to health insurance administration services you have requested

Consent is not required as a condition of purchasing any product or service. You may provide or withdraw consent independently of any service agreement.

3. Message Frequency

Message frequency varies based on your interactions with our customer support team and the status of your enrollment or service requests. You will not receive more than 10 service-related messages per month unless you have an active customer support conversation in progress.

4. Opt-Out

You may revoke your consent to receive messages at any time by any of the following methods:

  • Replying STOP to any SMS or MMS message from Rivendell
  • Sending a message saying “stop” or “unsubscribe” via iMessage to (646) 600-8840
  • Emailing [email protected] with the subject line “Opt-Out Messaging” and including your phone number
  • Calling (646) 600-8840 and requesting removal from messaging communications

We will process your opt-out request within 10 business days in accordance with FCC regulations. After processing your opt-out, you will receive a single confirmation message and no further messages. After opting out, you may still receive one-time transactional messages required by law or necessary for the administration of active insurance coverage that you have previously authorized.

6. Message and Data Rates

Message and data rates may apply depending on your wireless carrier and plan. Rivendell does not charge for messages, but standard messaging rates from your carrier apply. Contact your wireless provider for details about your messaging plan and any charges that may apply.

7. Carrier Disclaimer

Message delivery is subject to the capabilities and policies of your wireless carrier and device. Neither Rivendell nor any wireless carrier is liable for delayed or undelivered messages. Service is available on major U.S. wireless carriers. Carrier participation and availability may change without notice.

8. iMessage-Specific Disclosures

When communicating with Rivendell via Apple iMessage:

  • Messages sent between Apple devices using iMessage are encrypted in transit using Apple's end-to-end encryption. When either party is not using an Apple device, messages may be sent as standard SMS or MMS, which are not end-to-end encrypted.
  • iMessage conversations may be stored on Apple's servers and on your device in accordance with Apple's privacy policies, which are outside of Rivendell's control. You can review Apple's privacy practices at apple.com/privacy.
  • Rivendell maintains internal records of customer support conversations conducted via iMessage for compliance, quality assurance, and record-keeping purposes.

9. Privacy and Protected Health Information

We handle all information transmitted through messaging channels in accordance with our Privacy Policy and applicable laws including HIPAA.

However, text and messaging channels, including iMessage, traverse third-party networks including carrier infrastructure and Apple's iMessage service that are outside Rivendell's direct control. These channels may not meet the standards required for transmission of certain categories of Protected Health Information.

Do not send sensitive information such as Social Security numbers, full insurance policy numbers, financial account numbers, or detailed health information via text or iMessage. For transmitting sensitive information, please use our secure platform at rivendell.health or call us at (646) 600-8840.

10. Eligibility

Our messaging services are available to residents of the United States aged 18 or older.

11. Changes

We may update these Mobile Terms from time to time. Changes will be posted at rivendell.health/mobile-terms with an updated effective date. If we make material changes, we will notify you by sending a message to your phone number on file or by other means.

12. Governing Law

These Mobile Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles, and applicable federal law, including the Telephone Consumer Protection Act (47 U.S.C. §227) and FCC regulations thereunder. For California residents, the provisions of California law apply to the extent described in our California Privacy Supplement.
